“记忆权”和“被遗忘权”蕴含着两种不同的信息价值取向。在社会治理转型和数字技术冲击下,它们逐渐纳入数字法治框架之中,但也会触发一系列关于权利运用的反思。文章基于法学和信息资源管理学科的双重视角,梳理记忆权和被遗忘权的法理依据和主体权责,识别数字时代记忆和遗忘的四重权利悖论,包括观念悖论、主体悖论、制度悖论、技术悖论。通过悖论讨论呈现出记忆和遗忘的结构化特征,借助司法案例和既有经验,提出应对策略:遵循数字正义要求,纳入数字法治框架,平衡公私权利关系,合理运用技术工具。
"The Right to Memory (RTM)" and "the Right to Be Forgotten(RTBF)" contain two different information value orientations. Under the transformation of social governance and the impact of digital technology, they are gradually incorporated into the digital rule of law framework, but they will also trigger a series of reflections on the use of rights. Based on the dual perspectives of law science and information resource management studies, the article sorts out the legal basis and subject rights and responsibilities of the RTM and the RTBF, and identifies the four paradoxes of them in the digital age, including conceptual paradox, subjective paradox, institutional paradox, technical paradox. The paradox discussion presents the structural characteristics of memory and forgetting, and with the help of judicial cases and existing experience, it proposes coping strategies: follow the requirements of digital justice, incorporate the digital rule of law framework, balance the relationship between public and private rights, and rationally use technical tools.
