: 文章通过描述大数据监控社会的技术性特征、社会性特征，分析风险社会和福利国家对大数据监控社会形成的推动力，展示了大数据监控社会中，政府如何通过大数据监控技术实现对社会无差别、全方位的监控。文章认为，大数据监控社会中，隐私权面临价值危机、实体权利失衡、程序控制失当等多重危机。文章提出，要保护隐私权，必须从理论上重新定位隐私权的价值，重新构建隐私权的功能，即实现隐私权防御绝对权力的功能和发挥隐私权规范权力透明运行的功能，并从立法、监督两方面构建系统化的隐私权保护法治框架。

The technical and social characteristics of big data surveillance society have been analyzed as well as the impetus from risk society and welfare state to form the big data surveillance. This paper shows how big data surveillance society allows governments to survey everyone undifferentiated and universally. The value of the right to privacy to democratic society and its substantive right and procedural right have been challenged in the big data surveillance society. In order to protect the right to privacy, the value of privacy should be reevaluated theoretically, and its functions of opacity to power and transparency to power should be implemented. The legal framework of privacy right protection should be reconstructed from both sides of legislation and judicial oversight.
